Commercial Pool Construction: common questions

Which license covers building a community or hotel pool in Florida?

Florida's commercial pool/spa contractor scope, defined in s. 489.105(3)(j), Florida Statutes, covers any swimming pool, public or private. Playwell's Certified Pool/Spa Contractor license, CPC1457140, is issued to licensee Donald Robert Glenn and verifiable on the Florida DBPR license search. General information, not legal advice.

Does our association have to get competitive bids?

Florida requires competitive bids for condominium association contracts that exceed 5 percent of the total annual budget, including reserves (s. 718.3026, F.S.), and for homeowners association contracts that exceed 10 percent (s. 720.3055, F.S.). Exceptions apply; the association's attorney decides. General information, not legal advice.

Is a pool at an apartment community or hotel a public pool?

Florida's definition of a public swimming pool in s. 514.011, F.S., includes pools at hotels, motels, apartments, townhouses and other cooperative living projects of five or more units, as well as schools, cities, counties and parks. The Department of Health makes the determination for a specific facility.

Do you work as a pool subcontractor for general contractors?

Yes. General contractors and developers can send plans and the bid due date through the bid request form, and Playwell responds with its scope and exclusions for the pool package.
