# Apartment community pools that help lease and keep residents

> The pool is one of the first amenities a prospect sees on a tour. A refresh has to land before leasing season, stay inside the capital budget, and keep the community's permits and drain safety in order.

## What owners and asset managers need from a pool contractor

- Timed around lease-up: Work scheduled around leasing season, move-in peaks and resident events, agreed before the contract is signed.
- One point of contact: One person who answers for the schedule, the crew and the inspections, so the property manager is not coordinating trades.
- Permits and drain safety handled: The health department paperwork and federal drain-cover compliance treated as part of the job, not left to the property.
- Capital work that shows: Refresh packages residents notice: resurfacing, tile and coping, lighting and equipment, priced as separate line items.
- Documented for the asset report: Before and after photos and a closeout package the asset manager can file with the capital plan.
- Accessibility handled correctly: Multifamily common areas fall under the Fair Housing Act; the ADA pool rules apply where the pool is a public accommodation.

## What to define in an apartment pool bid

- Work package: Resurface, tile and coping, deck, lighting, equipment (Each priced as its own line item)
- Schedule constraints: Leasing season, move-in peaks and resident events

## Common questions

### Are apartment pools covered by the federal drain safety act?

Yes. The Virginia Graeme Baker Pool and Spa Safety Act defines a public pool to include pools open only to residents of a multi-unit apartment building or apartment complex (15 U.S.C. 8003). The CPSC names apartment complexes in its reminder that public pools need drain covers that meet the current standard, plus a second anti-entrapment system where there is a single blockable main drain.

### Does an apartment pool need a Florida Department of Health operating permit?

The exemptions in s. 514.0115, F.S., name condominiums, cooperatives and homeowners' associations. They do not name rental apartment communities, so plan on the public pool permit path and confirm with your county health department. General information, not legal advice.

### Does the ADA apply to our apartment pool?

The ADA pool rules apply to public accommodations and state and local government facilities. Housing is covered by the Fair Housing Act, which requires accessible common and public use areas in multifamily buildings of four or more units designed for first occupancy after March 13, 1991. If the pool is also open to the public, for example through memberships sold to non-residents, ask counsel whether ADA Title III applies. General information, not legal advice.

### Can the work be scheduled around leasing season?

Yes. Set the start date and closure window in the contract around leasing season and move-in peaks. How long the pool is closed depends on the scope, the finish manufacturer's cure and startup specs, and the inspections the permit requires.

### How do we get a bid?

Send the community, the scope and the window you can close through the request-a-bid form, or call (407) 403-2794. Playwell reviews the request, contacts you, and walks the site before pricing anything.
